Article 1 — Purpose and Scope

These General Terms and Conditions of Sale (hereinafter "GTCS") govern, without restriction or reservation, all sales concluded on the website essabricoffee.com (hereinafter the "Site") between ESSABRI Coffee and any non-business individual (hereinafter the "Customer") wishing to purchase the products offered for sale.

Any order placed on the Site implies full and unreserved acceptance of these GTCS. The Customer acknowledges having read them prior to placing their order and declares acceptance by ticking the dedicated box during the order process.

Article 3 — Products

Essabri Coffee offers specialty coffees artisanally roasted in Saint-Maximin-la-Sainte-Baume (France), packaged in 250 g and 1 kg bags.

The essential characteristics of the products (origin, variety, process, tasting notes, net weight, recommended consumption date after roasting) are listed on each product page. Product photographs are provided for illustrative purposes only and do not bind the seller.

Products are offered within the limits of available stock. In case of unavailability after order, the Customer will be informed by email as soon as possible and may opt for a full refund or an exchange.

Article 4 — Prices

Product prices are indicated in euros (€), inclusive of all taxes (VAT included), excluding shipping fees. Coffee is subject to the reduced French VAT rate of 5.5% applicable to food products. Shipping fees are calculated and displayed to the Customer before the final validation of the order, based on the chosen delivery method and destination zone.

Essabri Coffee reserves the right to modify its prices at any time. However, products will be invoiced based on the rates in force at the time of order validation.

The applicable VAT rate is the one in force in France on the date of the order. For deliveries outside the European Union, see Article 11.

Article 5 — Order

The Customer places an order by selecting products, adding them to the cart, then validating the cart after entering their delivery and billing details, choosing their delivery method and payment method.

Before final validation, a detailed order summary is presented to the Customer, including: the list of products, their unit price, the total amount including VAT, shipping fees, delivery address, and payment method. The Customer must then tick the acceptance box for these GTCS.

The order is only definitively registered after payment confirmation. An order confirmation email containing the summary is then sent to the Customer. This contract is electronically archived by Essabri Coffee and may be communicated to the Customer upon simple request.

Essabri Coffee reserves the right to refuse or cancel any order for legitimate reasons, including: previous dispute, payment default, abnormal order, suspicion of fraud.

Article 6 — Payment

Payment is made online at the time of order by credit card (Visa, Mastercard, American Express) via a secure platform (Shopify Payments / Stripe), or by any other payment method offered at the time of order (Apple Pay, Google Pay, PayPal).

Transactions are secured by SSL/TLS encryption and processed in compliance with the PCI-DSS standard. Essabri Coffee never has access to the Customer's full banking details.

The Customer's account is debited upon order validation. The order will be considered effective from the confirmation of payment acceptance by the banking institution.

In the event of payment default, false details, or fraud, Essabri Coffee reserves the right to suspend or cancel the order, without prejudice to any subsequent legal action.

Article 7 — Delivery

Products are delivered to the address indicated by the Customer at the time of order. Several delivery methods are offered depending on the destination zone:

  • Mainland France: Mondial Relay (pickup point, 3-5 days), Colissimo Home Delivery (48-72h), Chronopost (24h)
  • European Union: Colissimo International, Chronopost International
  • Rest of the world: Colissimo Worldwide, Chronopost Express

Delivery times are indicative and run from the shipment of the order (and not from the order date). Orders are shipped within 2 to 5 business days following roasting, to guarantee optimal freshness.

In accordance with Article L216-1 of the French Consumer Code, in the event of a delivery delay of more than 7 days from the scheduled date (except in cases of force majeure), the Customer may, after an unsuccessful formal notice, terminate the contract and obtain a full refund.

The transfer of risks related to the product occurs upon the effective handover of the parcel to the Customer.

Article 8 — Right of Withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of their order to exercise their right of withdrawal, without having to justify their decision.

Exceptions: in accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot be exercised for food products unsealed after delivery (opened coffee bags) or for products likely to deteriorate or expire rapidly.

Article 9 — Legal Warranties

All products sold by Essabri Coffee benefit from the following legal warranties, at no additional cost to the Customer:

  • Legal warranty of conformity (Articles L217-3 to L217-17 of the French Consumer Code): the Customer has 2 years from the delivery of the goods to act
  • Warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code): the Customer may choose between rescission of the sale or a price reduction, within 2 years of discovering the defect

To exercise these warranties, the Customer must contact Essabri Coffee at contact@essabricoffee.com describing the observed defect, with supporting photographs.

Article 10 — Liability

Essabri Coffee cannot be held liable for non-performance of the contract in cases of force majeure, fault of the Customer, or unforeseeable and insurmountable act of a third party unrelated to the service.

Essabri Coffee's liability shall in no case be engaged for indirect damages such as loss of business, loss of opportunity, or commercial prejudice.

The Site may contain hyperlinks to other websites. Essabri Coffee exercises no control over these sites and declines all responsibility for their content.

Article 11 — Customs Duties and Import Taxes

For orders delivered outside the European Union, the Customer is solely responsible for the payment of customs duties, local VAT, taxes, and import fees that may be due in the destination country. These fees are not included in the order price or in the shipping fees displayed on the Site.

The Customer is invited to inquire with the competent authorities of their country before placing an order. Refusal to pay these fees or to receive the parcel does not entitle the Customer to any refund of shipping fees.

Article 12 — Intellectual Property

All elements of the Site (texts, images, logos, photographs, graphics, trademarks, domain name) are the exclusive property of Essabri Coffee or its partners and are protected by French and international intellectual property law.

Any reproduction, representation, modification, or exploitation, in whole or in part, by any means whatsoever, without the express prior authorization of Essabri Coffee, is strictly prohibited and constitutes an infringement punishable under Articles L335-2 et seq. of the French Intellectual Property Code.

Article 13 — Personal Data

Personal data collected as part of sales are processed in accordance with Regulation (EU) 2016/679 (GDPR) and the French Data Protection Act. The processing methods, the Customer's rights, and the means of exercising them are detailed in our Privacy Policy.

Article 15 — Mediation and Dispute Resolution

In accordance with Articles L611-1 et seq. of the French Consumer Code, in the event of a dispute not resolved amicably, the consumer Customer may use a consumer mediator free of charge:

Article 16 — Applicable Law and Jurisdiction

These GTCS are subject to French law. In the event of a dispute, and after attempting amicable resolution, the French courts shall have sole jurisdiction, subject to the mandatory provisions applicable to consumers.

Article 17 — Modification of the GTCS

Essabri Coffee reserves the right to modify these GTCS at any time. The GTCS applicable to an order are those in force on the date of order validation.

Article 18 — Severability

If one or more provisions of these GTCS were declared null or unenforceable, the other provisions would retain their full force and scope.
