Cancellation policy

This policy governs subscriptions taken out on essabricoffee.com with ESSABRI Coffee (SASU, Draguignan Trade Register 105 710 933, registered office: 1177 Ancien Chemin de Gareoult à Rocbaron, 83136 Rocbaron, France). It supplements our Terms and Conditions of Sale, our Returns and Refund Policy and our Shipping Policy, which apply to each subscription delivery. By taking out a subscription, the Customer declares that they have read and accepted this policy.

1. Purpose and operation of the subscription

The subscription allows the Customer to automatically receive, at the frequency they choose, the selected coffee(s), together with the 10% subscriber discount applicable to eligible products. By subscribing, the Customer sets up an automatic recurring payment: they expressly authorise ESSABRI Coffee to charge the registered payment method, at each renewal date, the amount of the corresponding order (products, subscriber discount deducted, applicable delivery costs and taxes).

Each renewal gives rise to the preparation, dispatch and invoicing of a new order, followed by a confirmation email containing the summary and the invoice.

2. Products, availability and substitution

The coffees offered by subscription are specialty products, roasted by hand in Provence, whose origins and lots may change with arrivals and seasons. In the event of occasional unavailability of a coffee on a given renewal date, ESSABRI Coffee reserves the right to offer an equivalent product of comparable range and price, or to postpone the delivery concerned, after informing the Customer by email. The Customer retains the ability to modify or cancel their subscription under the conditions below.

3. Prices, invoicing and price changes

Subscription prices are shown in euros (€), inclusive of all taxes, with the reduced VAT rate of 5.5% applicable to foodstuffs included. Delivery costs, calculated according to weight, destination and shipping method, are added to the product price and shown before each validation.

The rate applied at each renewal date is that in force on the invoicing date of that renewal. In accordance with consumer law, in the event of a change to the subscription price, the Customer is informed by email before the renewal concerned and may cancel free of charge if they do not accept the new rate. Failing cancellation before the renewal following this notification, the new rate is deemed accepted.

The 10% subscriber discount is valid only during the active period of the subscription and on eligible products; it does not apply to one-off purchases and cannot be combined with other promotional codes, unless expressly stated otherwise.

4. Duration, renewal and consumer information

The subscription is concluded without any minimum commitment period and renews automatically at each renewal date until cancelled by the Customer. In accordance with Articles L215-1 et seq. of the Consumer Code, the Customer is informed of each renewal and retains the possibility at any time of not renewing it by cancelling under the conditions set out in Article 6.

5. Management of the subscription by the Customer

The Customer manages their subscription independently, at any time, from their customer account on essabricoffee.com. They may in particular:

  • modify the delivery frequency;
  • temporarily suspend (pause) or skip one or more deliveries;
  • update their delivery address and payment method;
  • modify the products in their subscription, within the limits of available offers;
  • cancel their subscription.

Any modification is taken into account for upcoming renewals and does not affect an order already prepared or dispatched.

6. Cancellation

The Customer may cancel their subscription at any time, free of charge and without justification, directly from their customer account or by writing to contact@essabricoffee.com. In accordance with Article L215-1-1 of the Consumer Code, online cancellation is possible by a process as simple as subscribing.

In order to allow orders to be prepared while respecting the freshness of the coffee, any cancellation, pause or modification must be made at least forty-eight (48) hours before the date of the next renewal to be effective for it. A request received after this deadline takes effect from the following renewal. Any order already prepared, invoiced or dispatched before the cancellation takes effect remains payable and is non-refundable, subject to the right of withdrawal and legal warranties provided for in Articles 7 and 8.

7. Right of withdrawal

In accordance with Articles L221-18 et seq. of the Consumer Code, the Customer has a period of fourteen (14) days, from receipt of each delivery, to exercise their right of withdrawal.

However, in accordance with Article L221-28 of the same Code, the right of withdrawal cannot be exercised for goods which, by their nature, cannot be returned or are liable to deteriorate or expire rapidly, nor for foodstuffs unsealed after delivery and which cannot be reshipped for reasons of hygiene or health protection (opened coffee bags). The terms of exercise and refund are detailed in our Returns and Refund Policy.

8. Legal warranties

The Customer benefits, for each delivery, from the legal warranty of conformity (Articles L217-3 et seq. of the Consumer Code) and the warranty against hidden defects (Articles 1641 et seq. of the Civil Code). In the event of a defective, damaged or non-compliant product, the Customer contacts contact@essabricoffee.com within 48 hours of receipt, with supporting photographs; ESSABRI Coffee will then proceed with replacement or refund of the product concerned, return costs included.

9. Payment, incidents and unpaid amounts

Payment for each renewal is automatically charged to the registered payment method. It is the Customer's responsibility to maintain a valid and funded payment method. In the event of a payment failure (expired card, limit reached, insufficient funds, opposition), ESSABRI Coffee may re-present the payment and inform the Customer by email so that they can regularise their situation.

Failing regularisation, the order concerned may be suspended or cancelled, without this automatically ending the subscription. ESSABRI Coffee reserves the right to suspend deliveries until an unpaid amount has been regularised. Sums corresponding to orders already prepared or dispatched remain due.

10. Delivery, address and uncollected parcels

Deliveries are made according to the terms, zones and times described in our Shipping Policy. It is the Customer's responsibility to provide and keep up to date an accurate, complete and accessible delivery address.

In the event of a parcel returned to sender due to the Customer (incorrect or incomplete address, failure to collect at a pickup point or post office within the carrier's deadlines, refusal of receipt), ESSABRI Coffee may, at its choice: recharge the cost of a new dispatch, or refund the value of the products excluding the initial shipping costs, which remain payable. As coffees are foodstuffs, an uncollected and then returned parcel cannot, for reasons of hygiene, be put back on sale.

11. Suspension and cancellation at ESSABRI Coffee's initiative

ESSABRI Coffee reserves the right to suspend or cancel a subscription in the event of the Customer's breach of this policy or of the Terms and Conditions of Sale, in particular in the event of repeated non-payment, fraudulent use of the service, manifest abuse of the right of withdrawal or conduct harmful to the company. The Customer is informed by email. This right is exercised without prejudice to sums remaining due and to ESSABRI Coffee's remedies.

12. Personal data

Data collected in connection with the subscription (identity, contact details, order history, payment method processed exclusively by our payment provider) is processed in accordance with our Privacy Policy, established under the GDPR and the French Data Protection Act.

13. Amendment of this policy

ESSABRI Coffee reserves the right to amend this policy at any time. The version applicable to a renewal is that in force on the invoicing date of that renewal. In the event of a substantial change, the Customer is informed by email and may cancel if they do not accept the new conditions.

14. Applicable law and mediation

This policy is subject to French law. In the event of a dispute that could not be resolved amicably with our customer service, the consumer Customer may have free recourse to a consumer mediator:
