Terms of sale

These Terms of Sale apply to any order placed on the essabricoffee.com website with ESSABRI Coffee. They supplement our General Terms of Service, our Return and Refund Policy, and our Shipping Policy, which form an integral part of the sales contract.

2. Acceptance of Terms

Any order placed on essabricoffee.com implies full and complete acceptance of these Terms of Sale. The Customer acknowledges having read them before validating their order, in accordance with Article 1127-1 of the French Civil Code.

3. Products

The products offered for sale are specialty coffees artisanally roasted in Saint-Maximin-la-Sainte-Baume, packaged in 250 g and 1 kg bags. The essential characteristics (origin, variety, process, tasting notes, net weight) are listed on each product page.

Product offers are valid as long as they are visible on the Site, within the limits of available stock.

4. Prices

Prices are indicated in euros (€) inclusive of all taxes (VAT included), excluding shipping fees. Coffee is subject to the reduced French VAT rate of 5.5% applicable to food products. Shipping fees are calculated and displayed before the final validation of the order, based on the weight of the parcel, the destination, and the chosen delivery method.

ESSABRI Coffee reserves the right to modify its prices at any time. Products are invoiced on the basis of the rates in force at the time of order validation.

5. Order Process

The Customer places an order by following these steps:

  1. Selection of products and adding to cart
  2. Cart validation
  3. Entering delivery and billing details
  4. Choice of delivery method
  5. Choice of payment method
  6. Review of the order summary and acceptance of the General Terms
  7. Final validation and payment

The order is only definitively registered after payment acceptance by the banking institution. A confirmation email containing the order summary is then sent to the Customer.

6. Payment

Payment is made online at the time of order, using the following methods:

  • Credit card (Visa, Mastercard, American Express)
  • Apple Pay, Google Pay
  • PayPal (where applicable)

Transactions are secured by SSL/TLS encryption and processed in compliance with the PCI-DSS standard via the payment providers Shopify Payments and Stripe. ESSABRI Coffee never has access to the Customer's full banking details.

The account is debited upon order validation. In the event of payment default or refusal, the order is automatically cancelled.

7. Product Availability

Our products are offered within the limits of available stock. In the event of unavailability of a product after order, the Customer will be informed by email as soon as possible. The Customer may then choose between:

  • a full refund of the unavailable product,
  • exchange for an equivalent product,
  • postponement of delivery.

8. Retention of Title

In accordance with French Law No. 80-335 of May 12, 1980, ESSABRI Coffee retains ownership of the products sold until effective and full payment of their price by the Customer. The transfer of risks related to the products nevertheless occurs upon effective handover of the parcel to the Customer.

9. Delivery

The delivery terms (zones, carriers, times, fees, tracking) are detailed in our Shipping Policy.

10. Right of Withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has a period of fourteen (14) days from receipt of their order to exercise their right of withdrawal, without having to justify their decision.

The terms, exceptions (particularly for unsealed food products in accordance with Article L221-28), and refund conditions are detailed in our Return and Refund Policy.

11. Legal Warranties

All products benefit from the legal warranty of conformity (Articles L217-3 to L217-17 of the French Consumer Code) and the warranty against hidden defects (Articles 1641 to 1649 of the French Civil Code), at no additional cost.

In the event of a defective, damaged, or non-conforming product, the Customer may contact contact@essabricoffee.com within 48 hours of receipt, with photographs as evidence. ESSABRI Coffee will proceed with replacement or full refund, including return shipping costs.

12. Invoicing

An electronic invoice is sent to the Customer by email for each validated order. This invoice serves as proof of ownership subject to full payment of the price.

14. Consumer Mediation

In accordance with Articles L611-1 et seq. of the French Consumer Code, in the event of a dispute that could not be resolved amicably, the consumer Customer may use a consumer mediator free of charge:

15. Personal Data

Personal data collected as part of the order are processed in accordance with our Privacy Policy, established in accordance with the GDPR and the French Data Protection Act.

16. Applicable Law and Jurisdiction

These Terms of Sale are subject to French law. In the event of a dispute, and after attempting amicable resolution, the French courts shall have sole jurisdiction, subject to the mandatory provisions applicable to consumers.

17. Modification of the Terms of Sale

ESSABRI Coffee reserves the right to modify these Terms at any time. The terms applicable to an order are those in force on the date of validation of that order.
